Court: School board was wrong to keep girl who identified as boy from using boys’ bathroom at school


A Virginia school board has lost an attempt to keep a girl who identified herself as a boy from using the boys’ bathroom at school.

The loss came due to the Supreme Court deciding not to hear the case this week.

The Gloucester County, Virginia school board had barred transgender student Gavin Grimm from using the boys’ restroom. The school required Grimm to use a separate restroom. Grimm sued in 2015. An appeals court found the schools’ practice to be sex discrimination.

With the Supreme Court declining to hear the case, the appeals court decision against the Gloucester County school board stands. Grimm is now 22. Grimm and his attorneys have said the decision is a victory for gay and transgender rights. Experts say the decision does not set a national mandate or precedent.
